Candidate Terms of Service

These Terms are between ResumeStudio, Inc., a Delaware corporation ("Candix", "we"), and you, a candidate using the Candix platform. You must be 18 or older and use the platform for your own job search. The platform is not offered to, and may not be used by, residents of the EEA, the UK, or Switzerland. You consent to doing business with us electronically: notices, these Terms, and any updates arrive through the platform or your account email. We record when you accept these Terms.

These Terms contain an arbitration agreement and a class-action waiver (Section 9). You can opt out of both within 30 days of first accepting these Terms.

1. What Candix is, and what it costs you

Candix introduces you to companies that are hiring. Candidates pay Candix nothing. Companies pay us only when you accept an introduction.

2. How introductions work, and what we collect

This is the section to read carefully: it says what we collect and what we do with it; the Privacy Policy has the full detail.

  • When you join, we collect your profile: your work experience, education, skills, the salary you are asking for, where you want to work, whether you would need visa sponsorship, and any notes you share with us. If you interview with us, we record and transcribe the conversation only with your permission, which we ask for at the start of the call; transcripts help us present you accurately, and you can decline recording without losing access to the platform. We do not ask what you earn now or earned before, only what you are asking for; nor do we ask about protected characteristics, with one exception: the visa-sponsorship question in your profile, which we treat as sensitive. Because what you tell us, in interviews or elsewhere, may appear in what we deliver to companies you accept, do not share anything confidential, or anything you would not want a company to see. We take care in what we include, but treat that as best effort, not a promise.
  • We use your profile to find matches. Our systems compare your profile with each company's brief and select which introductions to propose; a person may review a match before we propose it. We do not send companies scores, rankings, or probabilities about you.
  • No hiring company receives your profile from us until you say yes. When we propose an introduction, we show you the company, and the proposal stays open for up to 7 days. Before you accept, the company receives nothing about you from us. By accepting, you direct Candix to deliver your profile to that company. We deliver it with a short summary of why we think the match fits, drawn only from your profile, your interviews with us, and public professional information about you; it is not a score. If you decline or ignore the proposal, that company learns nothing about you from us. There is no other way a hiring company obtains your Candix profile from us.
  • You may receive few or no introductions; not every profile matches an open brief. You can see your introductions and their status in the app; if something looks wrong, write to support@candix.com and a person will look into it.

You can ask at any time to see your profile as companies would receive it; we provide it within 5 business days. It reflects your profile at the time we provide it, and you can correct it in the app or by asking us.

3. What companies must do with your profile

Companies do not receive your profile as their property. Before a company receives anything, it accepts terms that require it to:

  • Use your profile only for the role you accepted. Your profile may be used solely to evaluate and conduct the specific recruitment you accepted the introduction for.
  • Tell no one. The company may not disclose your profile to anyone outside its own hiring process, and in particular may not reveal, confirm, or imply to your current employer that you are looking.
  • Never exploit it. No adding you to databases or mailing lists beyond the role you accepted, no using your data to train models, no contacting you about anything other than the recruitment.
  • Delete it when the recruitment ends, or cease actively using it; if the company hires you, it keeps your data as your employer.

The exceptions: the company's own service providers, bound to the same confidentiality; records the law requires the company to keep; retention needed to establish or defend legal claims; routine backups; disclosures the law compels; and information the company already had or obtains from public sources.

From the moment of delivery, the company also holds your profile under its own privacy notice and is directly answerable to you for it; you can direct privacy requests to the company as well as to us. If you believe a company misused your data, tell us at support@candix.com: our agreement with the company lets us require it to stop and remediate.

4. Your commitments

  • Accuracy. Your profile is truthful and yours: your real identity, your real experience, your real asking salary. Companies rely on it, and so does our matching; materially false profiles may be removed.
  • One account, for yourself only; no impersonation and no accounts on behalf of others.
  • Keep it current. If you take a job or stop looking, tell us or close your account.
  • Confidentiality. Treat non-public information about companies you learn through introductions as confidential.
  • Ordinary use only. Use the platform as a person looking for work: no scraping or automated extraction, no interference with its systems, no unlawful use.

You grant Candix a non-exclusive, worldwide, royalty-free license to host, process, and display your profile content, and to deliver it as you direct, solely for the purposes described in Section 2 and the Privacy Policy. It is your data; the license ends when your data is deleted (as described in the Privacy Policy).

5. Referrals

You may have been referred to Candix by a company in our network; referrers can earn platform credits when people they referred accept introductions. This costs you nothing. Referrals affect matching in one way: to prevent conflicts of interest, we do not knowingly propose you to the company that referred you or its corporate group. Referrers see aggregate numbers: how many of the people they referred have signed up, and the credits they have earned; they do not see who. If a company referred only a few people, those numbers can still give away that you joined or accepted an introduction. Beyond those numbers, the company receives nothing about your activity, matches, or outcomes, and we do not confirm anything about you to it.

6. Our role, and what we don't promise

Candix introduces; it does not employ, and it does not decide.

  • We are an intermediary. Candix is not an employment agency or staffing firm, is not your employer or agent, and is not a party to any relationship you form with a company.
  • Companies decide. We don't make hiring decisions; companies do, and they are solely responsible for them.
  • We don't guarantee outcomes. We don't guarantee introductions, interviews, offers, or jobs. A proposed introduction is not an endorsement of the company or the role, and not a prediction of the outcome.
  • Verify what matters. We don't guarantee that a company's information is accurate or that a role is as described. Parts of the platform's content are generated with AI assistance and can contain inaccuracies. Check anything you intend to rely on before a decision that matters, like leaving a job.
  • Your dealings are your own. Interviews, negotiations, offers, and any employment that follows are between you and the company, and any dispute arising out of them is with the company, not with Candix.

To the maximum extent the law allows, the platform is provided "as is", and except as expressly stated here, Candix disclaims all warranties, express or implied.

7. Leaving

Close your account whenever you want by emailing support@candix.com. On our side, we may suspend or close your account for a materially false profile, material breach of these Terms, misuse of the platform, fraud, or where the law requires it; we state the reason where the law allows and, for fixable problems, allow a reasonable time to fix them. We may act on suspected fraud immediately, pending review. We may also discontinue the platform, or close accounts, with 30 days' notice.

8. Liability

To the maximum extent the law allows: neither of us is liable to the other for indirect, incidental, consequential, or punitive damages; and Candix's total liability arising out of or relating to these Terms or the platform is capped at USD 100. This allocation of risk reflects that the platform is free for candidates. The cap and these exclusions do not apply to fraud, gross negligence, or willful misconduct, to death or personal injury, or to any right or remedy that applicable law does not allow to be limited by contract, which may include statutory damages under privacy or consumer-reporting laws.

9. Disputes

  • Informal first. Before any formal proceeding, email support@candix.com describing the problem and what you want. We both agree to try in good faith, for 30 days from that email, to resolve the issue before either of us starts arbitration or court; limitation periods pause during those 30 days.
  • Your right to opt out. You can reject arbitration and the class waiver, keeping the rest of these Terms, by emailing support@candix.com within 30 days of first accepting these Terms, stating your name and that you opt out of arbitration and the class waiver.
  • Arbitration. Any dispute arising out of these Terms or the platform that we cannot resolve informally will be resolved by binding individual arbitration administered by the American Arbitration Association under its Consumer Arbitration Rules, in English, in the county where you live or by video. The Federal Arbitration Act governs this Section. Arbitration replaces court: a neutral arbitrator decides instead of a judge or jury, and review of the award is limited. You pay only the capped consumer filing fee under the AAA rules, or the cost of filing the same claim in court, whichever is less; Candix pays all other AAA fees and arbitrator compensation.
  • Carve-outs. Small-claims court remains available for qualifying claims. Either party may seek injunctive relief in court for misuse of the other's confidential information or intellectual property (for you, that includes misuse of your profile data). Nothing here waives any right to seek public injunctive relief where the law of your home state makes that right non-waivable; such a claim may be decided in court after arbitration of all arbitrable claims.
  • Class waiver. Disputes are resolved individually; neither of us participates in a class, collective, or representative action against the other. If this waiver is found unenforceable as to a particular claim, that claim (and only that claim) proceeds in court, and this Section otherwise remains in force.
  • Coordinated claims. If 25 or more similar claims are brought by the same or coordinated counsel, they will be administered under the AAA's Mass Arbitration Supplementary Rules, in staged batches of up to 20, with limitation periods paused while a claim awaits its batch. If your claim has not been assigned to an arbitrator within 18 months of filing, you may withdraw it and proceed in court instead. This procedure applies equally to claims by or against Candix. If this batching procedure is found unenforceable, claims proceed individually under the AAA rules without it.
  • Law and venue. Delaware law governs, and claims not subject to arbitration proceed in the state or federal courts located in Delaware or in small-claims court where you live; neither choice displaces protections, including venue rights, of the place you live that apply regardless of contract. Changes to this Section do not apply to disputes that arose before the change.

10. Changes

We may update these Terms with at least 15 days' notice through the platform or email. Material changes require your acceptance; if you decline, you can close your account, and if you have not accepted within 30 days of notice, we may close it for you. The prior terms govern until your account closes.

11. General

If any provision of these Terms is unenforceable, it is limited to the minimum extent necessary and the rest remains in effect. These Terms are the entire agreement between us about the platform; the Privacy Policy describes our data practices and is not part of these Terms. You may not assign these Terms; we may assign them to a successor of the business, with notice. Provisions that by their nature continue survive account closure, including Sections 8 and 9 and the license in Section 4, which continues until your data is deleted.
